New Cottage Food Law in Michigan

There's a new cottage food law in Michigan! Michigan House Bill 4122, originally introduced in early 2025, was revived in mid-December and signed into law by the Governor on December 23.
Prior MI cottage food law allowed for the production and sale of non-potentially hazardous foods that do not require time or temperature control (such as most baked items) from a home kitchen. Annual sales were limited to $25,000 and no license was required.
The new law will be effective on March 24, 2026.
In addition to sales by the producer direct to the consumer, it will allow in-state sales to consumers by internet, mail order, or delivery through a third-party food delivery platform, as long as the producer provides an opportunity for consumers to directly interact with the producer before the sale. Sales by consignment or at wholesale are prohibited.
The annual sales limit has also been raised to $50,000, though if the producer sells products at a price of $250.00 or more per unit, the gross annual sales limit is $75,000.00. After October 1, 2026, these limits will be adjusted for inflation.
