Two North Dakota farmers plan to appeal a recent lower federal court ruling that prevents them from commercial hemp farming.

The notice of appeal was filed today in the U.S. Court of Appeals for the Eighth Circuit, according to Vote Hemp, a national non-profit organization.

The farmers filed a federal lawsuit in June to end the U.S. Drug Enforcement Administration’s (DEA) ban on commercial hemp farming, but their case was dismissed on Nov. 28 by a Bismarck federal judge.
